1. Agreement to Terms
These Terms and Conditions ("Terms") govern your use of the John Paul II Holding Company, LLC website, resident portal (powered by Buildium), and SMS/text messaging services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is available at www.jp2rental.com/index.php/privacy-policy. If you do not agree to these Terms, you must not access or use our Services.
2. Description of Services
John Paul II Holding Company, LLC is a property management company that provides residential rental housing. Our Services include an online resident portal through Buildium for account management, rent payment processing, and communication; an SMS/text messaging program for transactional notifications related to your tenancy; and a website providing information about our properties, services, and company.
3. Age Restriction
You must be at least 18 years of age to use our Services, including our SMS/text messaging program, resident portal, and website. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are under 18 years of age, you are not permitted to use our Services. John Paul II Holding Company, LLC does not knowingly collect information from or direct its Services to individuals under the age of 18.
4. Account Registration and Security
To access certain features of our Services, you must create an account through the Buildium resident portal. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. John Paul II Holding Company, LLC will not be liable for any loss or damage arising from your failure to maintain the security of your account.
5. SMS/Text Messaging Terms of Service
5.1 Description of SMS Use Cases
John Paul II Holding Company, LLC uses SMS/text messaging to send transactional notifications to tenants who have opted in through the Buildium resident portal. The specific SMS use cases include:
Rent Payment Reminders: Text messages sent at scheduled intervals before and after your rent due date to remind you of upcoming or overdue payments. Reminders may be sent 7 days before, 3 days before, on the due date, and at intervals after the due date if payment has not been received.
Payment Confirmations: A text message confirming that your rent payment has been received and applied to your account.
Promise-to-Pay Reminders: If you make a commitment to pay on a specific date, text messages will be sent to confirm the commitment, remind you before the promised date, on the promised date, and follow up if payment was not received.
Installment Payment Plan Notifications: If you are on an approved payment plan, text messages will be sent to confirm the plan, remind you of installment due dates, and confirm when your balance is paid in full.
Account-Related Communications: Other transactional messages related to the status of your rental account.
5.2 Opt-In and Consent
By registering for an account on the Buildium resident portal and providing your mobile phone number with consent during the registration process, you expressly agree to receive text messages from John Paul II Holding Company, LLC. Consent to receive text messages is not required as a condition of tenancy, purchasing any property, or obtaining any services from us.
5.3 Message Frequency
Message frequency varies depending on your payment status and account activity. Typically, you may receive 1 to 5 messages per billing cycle. Additional messages may be sent in connection with payment plans, installment agreements, promise-to-pay arrangements, or account updates.
5.4 Message and Data Rate Disclosure
Standard message and data rates may apply. Text messages sent to or received from John Paul II Holding Company, LLC may incur charges from your wireless carrier based on your messaging plan. Please consult your wireless carrier for complete details regarding your messaging plan and any applicable fees. John Paul II Holding Company, LLC is not responsible for any message or data charges imposed by your wireless carrier.
5.5 Opt-Out Instructions
You may opt out of receiving text messages at any time. To opt out, reply "STOP" to any text message received from John Paul II Holding Company, LLC. After opting out, you will receive a one-time confirmation message confirming your removal from our messaging program. No further text messages will be sent to you unless you choose to re-subscribe. 5.7 Carrier Liability Disclaimer
Our SMS messaging program is supported by major U.S. wireless carriers. However, carriers are not liable for delayed or undelivered messages. John Paul II Holding Company, LLC is not responsible for messages that fail to be delivered due to carrier network issues, device incompatibility, changes to your phone number, technical malfunctions, or any other factors outside of our control. Neither John Paul II Holding Company, LLC nor any wireless carrier shall be liable for any delays, failures, or errors in any SMS messages sent or received in connection with our messaging program. Wireless carriers and their affiliates, employees, agents, and representatives are released from any and all claims, liabilities, and damages arising from or related to the SMS messaging program.
5.8 No Sharing of SMS Data
We will not sell, rent, loan, trade, lease, or otherwise share your mobile phone number or SMS opt-in information with any third parties for their marketing or promotional purposes. Your SMS consent and mobile phone number data are used exclusively by John Paul II Holding Company, LLC for the transactional messaging purposes described in these Terms and our Privacy Policy.
6. Rent Payments
Rent payments submitted through the Buildium resident portal are subject to the terms of your lease agreement. Payment processing times may vary, and it is your responsibility to ensure payments are submitted with sufficient time for processing before the due date. John Paul II Holding Company, LLC is not responsible for delays caused by financial institutions, payment processors, or technical issues beyond our control. Late fees and other charges will be assessed in accordance with your lease agreement.
7. Promise-to-Pay and Payment Plans
If you arrange a promise-to-pay commitment or an installment payment plan with John Paul II Holding Company, LLC, you agree to adhere to the agreed-upon schedule and amounts. Failure to comply with a payment commitment may result in additional fees, notices, and other remedies as outlined in your lease agreement. John Paul II Holding Company, LLC reserves the right to modify or revoke payment plan arrangements at its discretion.
8. Intellectual Property
All content on our website and Services, including text, graphics, logos, images, and software, is the property of John Paul II Holding Company, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
9. Prohibited Conduct
When using our Services, you agree not to: use the Services for any unlawful purpose or in violation of any applicable laws; attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services; interfere with or disrupt the operation of the Services; impersonate any person or entity or misrepresent your affiliation with any person or entity; transmit any viruses, malware, or other harmful code; or use the Services to send unsolicited communications or spam.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. JOHN PAUL II HOLDING COMPANY, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOHN PAUL II HOLDING COMPANY, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, WHETHER OR NOT JOHN PAUL II HOLDING COMPANY, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
